Article 2) Subject Matter

This contract regulates the mutual rights and obligations between the Consumer who orders the product specified below in terms of its characteristics and sales price from the canzerjewellery.com website and the Seller who is the owner of this website in accordance with the provisions of the Law No. 4822 on the Protection of Consumers and the Regulation on Distance Contracts Implementation Procedures and Principles.

Article 5) General Terms

1. Age Restriction:

  • Individuals under the age of 18 are not permitted to make purchases on the canzerjewellery.com website. By electronically confirming this contract, the Consumer confirms that they are over 18 years of age.

2. Pricing and Content Errors:

  • The Seller is not responsible for pricing and content errors arising from typing or system errors that may occur on the canzerjewellery.com website. The Seller reserves the right to cancel orders in which the price is displayed incorrectly.

3. Purpose of Purchase:

  • By making a purchase on canzerjewellery.com, the Consumer acknowledges that the purchase is for personal use and not for resale purposes.

4. Information Disclosure:

  • By electronically confirming this contract, the Consumer confirms that they have received accurate and complete information regarding the Seller's address, phone number, the basic characteristics of the ordered products, the prices of the products including taxes, payment and delivery information, prior to the conclusion of the distance contract.

5. Payment and Order Fulfillment:

  • If the product price is not paid for any reason or is canceled in the bank records, the Seller is considered to be relieved of the obligation to deliver the product.

  • For orders placed by bank transfer or EFT, the order processing date by the Seller is not the date the order was placed, but the date when the payment is reflected in the Seller's bank accounts.

  • The Consumer agrees that the Seller may cancel the order if payment is not made within 3 business days for orders placed by bank transfer or EFT.

6. Chargebacks and Unauthorized Use of Credit Cards:

  • In the event that a bank or financial institution does not pay the product price to the Seller due to unauthorized or illegal use of the Consumer's credit card by unauthorized persons, after the product is delivered, the Consumer is obliged to return the product to the Seller within 3 days, provided that the product has been delivered to them.

 

Article 6) Seller's Obligations

  • The Seller shall fulfill its obligations within thirty days at the latest from the moment the Consumer's order reaches the Seller. This period may be extended by a maximum of ten days, provided that the Consumer is notified in writing in advance.

  • The Seller shall not be held responsible for the non-delivery of the ordered product to the Consumer due to any problems that the cargo company may encounter during the delivery of the product to the Consumer.

  • The Seller shall not be held responsible for the non-acceptance of the delivery of the ordered product by the recipient at the delivery address.

  • Subject to a legitimate reason, the Seller may offer to supply the Consumer with a product of equal quality and price before the expiry of the performance period.

  • For various reasons, it may not be possible to manufacture the ordered products. If the Seller is unable to fulfill its contractual obligations by claiming that it is impossible to fulfill the ordered goods or services, it shall notify the Consumer of this situation before the expiry of the performance period arising from the contract. It shall return to the Consumer the price paid and all documents that have created an obligation within 10 days.

  • The Consumer has the right to withdraw from the contract within 14 days from the delivery of the product ordered to him or to the person/organization at the Delivery Address specified by him. In order to exercise the right of withdrawal, the Seller must be notified by e-mail and telephone within this period and the products must not be included in the scope of Article 7 - Products for which the Right of Withdrawal cannot be Used. The Seller has the right not to accept returns made without notification.

  • The Consumer is obliged to return to the Seller the packaging, certificate, invoice, and all other documents and materials of the product sent to him, completely together with the product return. The VAT and other legal obligations, if any, of the products for which the original invoice is not sent will not be refunded.

 

Article 7) Products for which the Right of Withdrawal cannot be Used

  • The Consumer cannot exercise the right of withdrawal for products that are produced or modified in accordance with the Consumer's special requests and demands and made special for the person. Therefore, products on which stones are written at the Consumer's request and all products produced at the Consumer's request are included in the scope of products for which the right of withdrawal cannot be used.

 

Article 8) Competent Courts

  • In the application of this contract, the Consumer Arbitration Boards up to the value announced by the Ministry of Industry and Trade and the Consumer Courts in the place of residence of the Consumer or the Seller shall be competent.

  • In the event of an order, the Consumer shall be deemed to have accepted all the conditions of this contract.
